Please read these Terms and Conditions carefully before engaging our services or using this website. By submitting an enquiry form or entering into a service agreement with us, you confirm that you accept these terms.
1. Definitions
- "We / Us / Our" — Sawasdee Law, a legal practice operating in Bangkok, Thailand
- "You / Client" — the individual engaging our services or using this website
- "Services" — the family legal services described on this website and in any engagement letter
- "Agreement" — these Terms and Conditions together with any engagement letter signed between the parties
- "Website" — the site accessible at this domain
2. Acceptance of Terms
By using this website or engaging our services, you confirm that you are at least 18 years old and have full legal capacity to enter into an agreement. If you are acting on behalf of another person, you confirm that you have authority to bind them to these terms.
Submitting an enquiry form does not in itself create a client-lawyer relationship. That relationship is established only upon the signing of an engagement letter and receipt of the agreed fee.
3. Services
Sawasdee Law provides family legal services in Thailand, currently comprising: Initial Family Consultation, Parenting and Arrangement Support, and Comprehensive Family Representation. The specific scope of each service is described on this website and in the engagement letter provided prior to commencement.
Services are delivered in Bangkok, Thailand. We may advise on matters with international elements but are not a law firm in any jurisdiction other than Thailand.
4. User Responsibilities
- You agree to provide accurate and complete information when contacting us or in the course of any engagement
- You agree not to use this website for any unlawful purpose or in any way that could harm its operation
- You agree not to reproduce, redistribute, or commercially use content from this website without our prior written permission
- You are responsible for maintaining the confidentiality of any access credentials if any are issued to you
5. Intellectual Property
All content on this website — including text, design, and structure — is the intellectual property of Sawasdee Law or its licensors. You are granted a limited, non-exclusive licence to access and view this content for personal, non-commercial purposes only. No content may be copied, reproduced, or used commercially without our written consent.
Documents and reports we produce for you as part of an engagement remain our intellectual property until all fees are paid in full, at which point the specific deliverable is transferred to you for your personal use in the matter.
6. Payment Terms
Fees are fixed and agreed in advance as set out in the engagement letter. All fees are quoted and payable in Thai Baht (฿). Payment is due prior to commencement of each service unless otherwise agreed in writing. We accept bank transfer and other payment methods as confirmed at engagement.
Refunds
The initial consultation fee is non-refundable once the session has taken place. For arrangement support and full representation, if work has not yet commenced, a refund of the fee is available within 7 days of payment. Once substantive work has begun, fees are not refundable except where we are unable to provide the service due to our own circumstances.
7. Service Delivery Terms
- Timelines stated on this website are indicative. Actual duration depends on the complexity of the matter and factors outside our control (including court schedules)
- Changes to scope must be agreed in writing before additional work is carried out
- We will communicate the status of your matter regularly. If you have not heard from us within 5 working days of expecting an update, please contact us directly
- We follow professional conduct rules of the Lawyers Council of Thailand at all times
8. Disclaimers
Legal outcomes depend on facts, evidence, and judicial discretion. We cannot and do not represent that any particular outcome will result from our services. All advice is based on the information available to us at the time it is given. We are not liable for decisions made on the basis of incomplete information provided to us.
This website is provided for informational purposes only. General information on this website does not constitute legal advice and does not create a lawyer-client relationship.
9. Limitation of Liability
To the extent permitted by Thai law, our total liability to you in connection with any engagement shall not exceed the fees paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential losses. This limitation does not apply to liability arising from our fraud, wilful misconduct, or gross negligence.
10. Indemnification
You agree to indemnify us against any claims, losses, or expenses arising from your breach of these Terms, your provision of inaccurate or incomplete information, or your unlawful use of this website.
11. Termination
Either party may terminate an engagement by written notice. If you terminate after work has commenced, you remain liable for fees proportionate to work completed. We may terminate an engagement if continued representation would conflict with our professional obligations, upon reasonable written notice to you.
Sections relating to intellectual property, limitation of liability, indemnification, and dispute resolution survive termination.
12. Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand. In the event of a dispute, we ask that you first contact us at [email protected] to seek informal resolution. If we cannot resolve the matter informally within 30 days, disputes shall be submitted to the jurisdiction of the courts of Bangkok, Thailand.
13. General Provisions
- Entire agreement: These Terms and any engagement letter constitute the entire agreement between us in relation to the subject matter
- Severability: If any provision is found unenforceable, the remaining provisions continue in full effect
- Waiver: Failure to enforce a provision does not constitute a waiver of the right to enforce it later
- Assignment: You may not assign your rights under any engagement without our written consent
- Notices: Formal notices should be sent to the address below or by email to [email protected]
14. Changes to These Terms
We may update these Terms from time to time. The revised version will be posted on this page with an updated date. Changes do not affect engagements already in progress unless both parties agree in writing.
